Samsung, Broadway Photo Settle Suit

Brooklyn, N.Y. - Broadway Photo, an online electronics retailer based here, has been prohibited from using Samsung product descriptions and photos following the settlement of a two-year-old lawsuit over unauthorized sales.

The action by Samsung also prohibits the e-tailer from providing misleading information about manufacturer warranty coverage for Samsung products sold on the site, and blocks Broadway Photo from selling Samsung products on third-party affiliated marketplaces.

"Samsung greatly values the strong relationship it has with its network of authorized dealers and resellers that help ensure consumers receive excellent customer service," said Tim Baxter, president of the consumer electronics division of Samsung Electronics America. "We will continue to be vigorous in protecting our authorized partners, our brand and products and addressing the actions of unauthorized dealers. Enforcement also helps us better serve consumers that run the risk of buying a product from an unauthorized dealer that may have been altered, used or refurbished and not protected by warranty."  

Samsung said it provides all retail partners with clear guidelines regarding the sales and marketing of the company's products, and works with third-party service providers to monitor unauthorized Internet sales and to track both print and online MAP violations to support and protect the company's approved dealer network.
