Patent Verdict For Apple Could Delay Smartphone, Tablet Launches

New York – A federal jury’s finding that 25 Samsung smartphone and tablets infringed on one or more Apple patents could delay Android smartphone and tablet launches as vendors pore over the decision to assess other potential infringements, analysts said.

For its part, Android inventor Google claimed most of the patents found to infringe don’t involve the core Android OS.

“While a ban would likely increase Apple’s leading smartphone share in the U.S. market, we believe this verdict could lead to Samsung also delaying near-term product launches as it attempts to design around Apple’s patents,” said Canaccord Genuity technology analyst Michael Walkley. “We also believe other Android OEMs, such as HTC, Sony and LG, will review this patent verdict and potentially alter and delay planned Android smartphones and tablets.”

Some analysts also contended that suit could sway handset vendors to put more emphasis on Windows Phone 8, and consumers might see fewer smartphone innovations as suppliers take a conservative approach to designing phones to ensure they don’t inadvertently infringe on Apple patents.

Last Friday, a federal district court jury penalized Samsung $1.05 billion for patent infringement, and Apple is drawing up a list of the infringing phones and tablets at issue — all older models — that it wants the court to ban from the U.S. with a preliminary injunction.

Apple has another suit before the court alleging infringement by newer Samsung products.

Samsung vows to appeal the verdict, whose penalties could be increased three-fold by the presiding federal judge because the jury found five instances in which Samsung willfully infringed patents.

The 25 phones and tablets found to infringe are the Captivate, Continuum, Droid Charge, Epic 4G, Exhibit 4G, Fascinate, Galaxy Ace, Galaxy Indulge, Galaxy Prevail, Galaxy S, Galaxy S Showcase, Galaxy S 4G, Galaxy S II (AT&T), Galaxy SII (T-Mobile), Galaxy S II (unlocked), Galaxy S II Skyrocket, Galaxy Tab, Galaxy Tab 10.1, Gem, Infuse 4G, Mesmerize, Nexus S 4G, Replenish, Transform and Vibrant.
