Apple iPhone Takes Top U.S. Smartphone Share: Survey

London, U.K. – Apple is having a very Merry Christmas, but carriers might not be.

Thanks to the iPhone 5, Apple’s share of U.S. smartphone sales to consumers have surged and exceeded 50 percent for the first during the 12 weeks ending Nov. 25, according to a survey conducted by Kantar Worldpanel ComTech. The research company expects Apple to make further gains in December.

Apple’s gains are expensive for the carriers, who subsidize the iPhone more heavily than other smartphones.

San Jose, Calif. – A federal district court denied Apple’s request to permanently ban the sale of 26 Samsung smartphones and tablets found by a jury to infringe on multiple Apple patents.

In August, a jury awarded Apple $1.05 billion in damages over the infrigement.

 The judge also refused a Samsung request to hold a new trial over alleged jury misconduct.

Apple Licensees: Partners In Profit And Pain

Some audio suppliers are really chafing under the Kremlin-like secrecy that surrounds Apple’s new-product plans. Maybe it’s good business to keep the competitors guessing, but Apple’s partners complain they’re suffering collateral damage in the smartphone and tablet wars.

Bonn, Germany — T-Mobile USA has entered into an agreement with Apple to bring products to market together in 2013, T-Mobile parent Deutsche Telekom announced.

T-Mobile, which is losing subscribers, is the only national carrier not offering the iPhone or iPad.

Deutsche Telekom didn’t say whether an iPhone or an iPad would be offered, but details of the agreement with Apple might be forthcoming today at Deutsche Telekom’s annual investors’ conference.

Taoyuan, Taiwan – HTC and Apple said they settled all their Android-related patent disputes around the world and have entered into a 10-year cross-licensing agreement for current and future patents.

The companies dropped all their current lawsuits against each other. The companies declined to disclose additional details.

"HTC is pleased to have resolved its dispute with Apple, so HTC can focus on innovation instead of litigation," said HTC CEO Peter Chou.

 Framingham, Mass.—Apple’s share of worldwide tablet shipments slipped sequentially and year-over-year in the third quarter because of rising competition and consumers who postponed Apple purchases while waiting for the company to launch its latest iPads, IDC said.

Boston – The number of iPhone users who said they will probably or definitely buy another iPhone declined for the first time since the iPhone’s 2007 launch, Strategy Analytics said.

The decline was more marked in Western Europe than in the U.S.

Cupertino, Calif. — Apple said revenue was up for its fiscal 2012 fourth quarter, ended Sept. 29.

 The company posted quarterly revenue of $36 billion and quarterly net profit of $8.2 billion, compared with the prior-year period’s $28.3 billion and $6.6 billion, respectively.  

For the quarter, Apple said it sold 26.9 million iPhones (58 percent growth) 14 million iPads (26 percent unit increase) 4.9 million Macs (1 percent unit increase), and 5.3 million iPods (19 percent unit decline).
