XM Continues To Resolve Pioneer Inno Lawsuits

By Amy Gilroy -- TWICE, 6/26/2008

New York — Continuing to work towards a settlement of two lawsuits, XM Satellite Radio said that EMI Music Publishing has withdrawn from a lawsuit against the company over the Pioneer Inno and its advanced recording features.

No terms of the resolution were disclosed.

Several smaller publishers still remain party to the lawsuit filed in March 2007 against XM by several music publishers for the advanced recording capabilities of the Pioneer Inno headset radio. An XM spokesman said the company looks forward to settling with the remaining parties.

XM is also still trying to settle a second lawsuit, filed in 2006, also over the recording capabilities of the Inno by music companies (as distinguished from music publishers). In that regard, XM announced only two weeks ago that EMI Music (a separate division of the EMI Group from EMI Music Publishing) also settled with XM. Regarding that suit, XM also settled with all key recording labels including Universal Music Group, Warner Music Group and Sony BMG, but has yet to settle with some smaller recording labels, it said.

The Pioneer Inno records blocks of XM programming like a DVR and lets users select individual songs to keep in memory for as long as their XM subscription is current.
