XM Settles With EMI

New York — XM Satellite Radio resolved the lawsuit brought by EMI against XM over the Pioneer Inno digital media player, marking the last of the four major record labels to settle the suit filed in 2006.

EMI and XM did not disclose terms of their agreement.

XM said the Pioneer Inno lawsuit is still not fully resolved as agreements must be reached with several independent record labels and music publishers.  A spokesman for XM said, “We look forward to settling with our other partners in the music industry.”

XM settled with Universal Music Group and Warner Music Group in December 2007 and with Sony BMG in February 2008 regarding a suit brought in May 2006 by members of the record industry citing copyright infringement by the Pioneer Inno, which uses the XM service. The device records blocks of XM programming like a DVR and lets users select individual songs to keep in memory for as long as their XM subscription is current.
